General terms and conditions events
Read below the general terms and conditions that apply to all Enjoy & Perform 'Hockey Below The Sea' events.
Article 1 - Definitions
In these general terms and conditions, hereinafter referred to as “General Terms and Conditions”, which can be consulted via the Hockey Below The Sea website, the following definitions apply:
1.1. “Hockey Below The Sea”: The Hockey Center bv, known under the trade name Hockey Below The Sea, located in Almere.
1.2. “Participant”: the natural person who uses a Hockey Below The Sea Event in accordance with the Agreement between Hockey Below The Sea and the Client.
1.3. “Registration form”: the form on the Hockey Below The Sea Website or Google forms.
1.4. “Client”: the natural person or legal entity who enters into the Agreement with Hockey Below The Sea.
1.5. “Agreement”: the agreement between Hockey Below The Sea and the Client regarding participation by the Participant in a Hockey Below The Sea Event.
1.6. “Travel sum”: the total sum, excluding insurance and cancellation risk cancellation, of one or more services to be provided by Hockey Below The Sea for the benefit of the Client and the Participant.
1.7. “Event”: a day camp organized by Hockey Below The Sea, a clinic, hockey promotion as further defined in the Hockey Below The Sea offer on the Website and the Registration Form.
1.8. “Website”: the website of Hockey Below The Sea, being the URL: www.hockeycentre.nl/Hockeybelowthesea
Article 2 - Applicability
2.1. These General Terms and Conditions apply to all offers, order confirmations and resulting or related agreements or further agreements made by Hockey Below The Sea.
2.2. Hockey Below The Sea expressly does not agree with the applicability of any general (and/or specific) terms and conditions and/or stipulations of the Client and/or Participant.
2.3. Deviations from or additions to - in whatever form - the Agreement or the General Terms and Conditions only apply if Hockey Below The Sea has agreed to this in writing in advance.
2.4. In the event of a conflict between the provisions of the General Terms and Conditions and/or provisions of the Agreement, the latter shall prevail.
2.5. If any provision of these General Terms and Conditions is not applicable or is contrary to Public Order or the Law, then only the relevant provision will be considered not to have been written and the other General Terms and Conditions will remain in full force and effect.
2.6. Hockey Below The Sea is entitled at any time to unilaterally change these General Terms and Conditions and/or the Agreement.
2.7. Hockey Below The Sea is entitled to change the prices of an Event at any time. It may happen that an Event is temporarily offered for a lower or higher price. This does not entitle you to a refund.
Article 3 - Registration
3.1. All offers from Hockey Below The Sea are without obligation and subject to available capacity, unless expressly agreed otherwise.
3.2. The Agreement is concluded after the Client has digitally submitted the Registration Form, which can be found on the Website.
3.3. When registering via the internet, there is a 14-day cooling-off period due to distance purchasing. Within this period, registration may be canceled free of charge without giving any reason, provided this is done in writing, addressed to events@hockeycentre.nl .
3.4. Any changes made after 14 days of the confirmation date will incur an administration fee of €7.75.
Article 4 - Payment
4.1. Payment must be made within 14 days of receiving the digital reservation confirmation from Hockey Below The Sea and before the start of the Event.
4.2. For reservations made after May 31 of each calendar year, payment must be made within 7 days of receipt of the reservation confirmation and before the start of the Event.
4.3. If payment is not made on time, the Client will be in default by operation of law, without any notice of default being required.
4.4. In the event of late payment, Hockey Below The Sea reserves the right to cancel the Agreement and the Client is liable for the cancellation costs, subject to the provisions of Article 12 paragraph 2 or Article 12 paragraph 3 of these General Terms and Conditions.
Article 5 - Rules of conduct
5.1. The Participant is obliged to comply with all reasonable instructions from Hockey Below The Sea to promote the proper execution of the Agreement. The Participant must also respect the rules of conduct that Hockey Below The Sea wishes to see observed during the stay at accommodations under the Agreement.
5.2. Participant who causes or may cause nuisance or nuisance, in such a way that proper execution of the Agreement by Hockey Below The Sea is greatly hampered, may be excluded by Hockey Below The Sea from further participation in the Event. This is at the discretion of the event manager of the Event. In this case, the Client and/or Participant are not entitled to a refund of - part of - the payment for participation in the Event in question. All resulting costs and damage will be borne by the Client and/or Participant.
Article 6 - Privacy
6.1. The Client and Participant agree that (personal) data that the Client provides from the Client and the Participant to Hockey Below The Sea may be used to the extent necessary for the performance of the Agreement and related purposes, including, but not limited to, provided to Hockey Below The Sea may be used for, among other things, but not limited to, editorial, commercial and promotional purposes surrounding Hockey Below The Sea events, analysis purposes and making targeted offers.
6.2. The Client and the Participant agree that (personal) data that the Client provides from the Client and the Participant to Hockey Below The Sea may be used for, among other things, but not limited to, editorial, commercial and promotional purposes surrounding Hockey Below The Sea Events and the making targeted offers from partners of Hockey Below The Sea: the Royal Dutch Hockey Association and the National Hockey Academy.
6.3. The Client and Participant have the right to view the (personal) data of the Client and Participant processed by Hockey Below The Sea.
6.4. At the written request of the Client and/or Participant, the (personal) data of the Client and Participant processed by Hockey Below The Sea will be deleted from the Hockey Below The Sea database.
Article 7 - Image and sound material
7.1. The Client and Participant agree that during and/or around Hockey Below The Sea Events in which the Participant participates, sound recording(s), photo(s) and/or video(s) will be made containing the recognizable image of the Client and/or or Participant and that these sound recording(s), photo(s) and/or video(s) made by Hockey Below The Sea may be used by Hockey Below The Sea for any purpose, including but not limited to editorial, commercial and/or promotional purposes.
7.2. The Client and/or Participant unconditionally transfer to Hockey Below The Sea.
7.3. If the Client and/or Participant do not agree to the making and/or use of the sound recording(s), photo(s) and/or video(s) as referred to in paragraph 1 of this article, then the Client and/or or to inform the Hockey Below The Sea Participant of this in writing prior to the relevant Hockey Below The Sea Event, addressed to events@hockeycentre.nl .
Article 8 - Lost property
8.1. Lost property from the camps or other events of Hockey Below The Sea will be kept at the club where the event took place for up to two weeks after the end. After this period has expired, Hockey Below The Sea is entitled to transfer the found items to a good cause.
8.2. We charge the Client and/or Participant service costs for the return of found objects.
Article 9 - Liability Hockey Below The Sea
9.1. Hockey Below The Sea excludes - except in the case of damage caused by intent and/or gross negligence on the part of Hockey Below The Sea - any liability for damage to luggage and/or other personal property of the Participant, whether or not placed in the custody of Hockey Below The Sea , as a result of theft, loss and/or damage.
9.2. Participation in a Hockey Below The Sea Event - except in the event of damage caused by intent and/or gross negligence on the part of Hockey Below The Sea - is entirely at the Client's and/or Participant's own risk. Hockey Below The Sea completely excludes all liability as a result of injuries, injuries, physical complaints or inconveniences in the broadest sense of the word, which arise during or as a result of a Hockey Below The Sea Event and is in no way obliged to pay damages and/or costs nor refund the costs of participation.
9.3. Hockey Below The Sea accepts no liability for damage for which there is a claim for compensation under travel and accident insurance or under (liability) insurance of third parties involved by Hockey Below The Sea in the execution of the Agreement.
9.4. Hockey Below The Sea accepts no liability for the transport of the Participant - except in the case of individual transport by Hockey Below The Sea itself or except in the case of intent or gross negligence on the part of Hockey Below The Sea. If necessary, the participant must contact the relevant carrier. At the request of the Participant and/or Client, Hockey Below The Sea will provide the name of the relevant carrier.
9.5. Without prejudice to the provisions of the previous paragraphs of this article, any liability of Hockey Below The Sea is limited to the amount to which it is entitled in the relevant case under its (liability) insurance(s).
9.6. The texts, photos and videos on the Website describe as well and accurately as possible what a Hockey Below The Sea Event entails. Despite this representation of a Hockey Below The Sea Event as truthfully as possible, this representation is not binding. Possible deviations from this - for whatever reason - are possible.
Article 10 - Liability of Client and/or Participant
10.1. The Client is severally liable for all damage that has/will arise for Hockey Below The Sea and/or any third party as a direct or indirect result of an attributable shortcoming - non-compliance with the rules of conduct as described in Article 5 of these General Terms and Conditions - of the Participant.
10.2. The Client will indemnify Hockey Below The Sea against claims from third parties for compensation for damage arising from or related to the Participant's use of facilities and/or services under the Agreement.
Article 11 - Force majeure, change or cancellation by Hockey Below The Sea
11.1. If Hockey Below The Sea is wholly or partially prevented from fulfilling one or more of its obligations arising from the Agreement due to force majeure, Hockey Below The Sea is entitled to offer an alternative that it deems equivalent, as described in paragraph 3 of this article. or to suspend the Agreement in whole or in part without judicial intervention, by means of a Hockey Below The Sea voucher, described in Article 16 of these General Terms and Conditions, or to have it terminated, without Hockey Below The Sea having to pay any compensation to the Client has been held.
11.2. Force majeure, as referred to in paragraph 1 of this article, includes, but is not limited to:
a. The circumstance that third parties engaged by Hockey Below The Sea, such as suppliers, hockey clubs, (sports) accommodations, transporters or other parties on which Hockey Below The Sea is dependent, do not fulfill their obligations or do not fulfill them on time;
b. Weather conditions, natural disasters, pandemics, terrorism, cybercrime, disruptions to the (digital) infrastructure, road blockages, strikes or work stoppages and travel and trade restrictions;
c. Insufficient registrations for participation in a hockey camp, which occurs if the number of registrations is less than 70 participants for an Overnight Camp and 20 for an (International) Day Camp.
11.3. An equivalent alternative includes, but is not limited to, Events in the same price range, the same period and the same age group.
Article 12 - Cancellation by Client
12.1. Cancellation must be made in writing, addressed to events@hockeycentre.nl , whereby the date of the cancellation email will serve as the reference date for the provisions of paragraph 2 or paragraph 3 of this article.
12.2. In the event of cancellation of the Agreement for an Overnight Camp of Hockey Below The Sea, the following amounts will be charged per Participant:
a. Up to and including 14 days after registration, 0% of the entire Travel Price;
b. Up to 12 weeks before the start of the Event, 30% of the entire Travel Price;
c. From the 84th day (inclusive) to the 42nd day before the start of the Event, 50% of the entire Travel Price;
d. From the 42nd day (inclusive) until the 5th day before the start of the Event 75% of the entire Travel Price;
e. From the 5th day (inclusive) until the day of the start of the Event and during the Event 100% of the entire Travel Price.
12.3. In the event of cancellation of the Agreement for a Day Camp or International Day Camp, the following amounts will be charged per Participant:
a. Up to and including 14 days after registration, 0% of the entire Travel Price;
b. Up to 30 days before the start of the Event, 15% of the entire Travel Price;
c. From the 30th day (inclusive) until the 14th day before the start of the Event, 35% of the entire Travel Price;
d. From the 14th day (inclusive) until the 1st day before the start of the Event 75% of the entire Travel Price;
e. On the day of the start of the Event and during the Event 100% of the entire Travel Price.
12.4. In the event of cancellation, the Participant is entitled to have another person substituted. You will then be charged €25.00 administration costs.
12.5. The Client can buy off the cancellation risk for a fee of 6% of the Travel Price per Participant. More information and the conditions are discussed in Article 15 of these General Terms and Conditions.
Article 13 - Changes by the Client
13.1. The Client and/or Participant has the right to make changes to the Agreement free of charge up to 14 days after concluding the Agreement.
13.2. In the case of Overnight Camps of Hockey Below The Sea, the Client and/or Participant is entitled to have additional changes made to his reservation up to and including 4 weeks before departure, including only a bus trip, airport service and travel and accident insurance. €7.75 administration costs will be charged for each change.
13.3. In the case of Day Camps and International Day Camps, the Client and/or Participant is at all times entitled to have additional changes made to his reservation, including only reducing or increasing the number of days of participation. No administration costs will be charged for these changes.
13.4. If the Surrender Cancellation Risk decreases, the premium of the policy may change if the Client and/or Participant changes the Agreement.
Article 14 - Insurance
14.1. The Client and/or Participant is obliged to take out travel and accident insurance with sports cover for the Participant during the period of the event.
14.2. Hockey Below The Sea offers Dutch and Belgian participants travel and accident insurance with extensive sports coverage with a premium of € 25.00 per camp. This insurance is placed with Hienveld bv.
14.3. The Client must take out insurance when concluding the Agreement. For any changes made after 14 days after concluding the Agreement, an administration fee of €7.75 will be charged.
14.4. For information about the policy conditions of travel and accident insurance or the submission and settlement of claims, the Client and/or Participant can contact Sem Vosters, Heilbron Assurantiën.
Article 15 - Waiver of cancellation risk
The cancellation risk can be bought off for a fee of 6% of the entire Travel Price. With regard to the arrangement to buy off the cancellation risk, the Client and/or Participant can only cancel for a valid reason.
15.1. The Cancellation Risk Waiver can be booked up to a maximum of 14 days after registration. € 7.75 administration costs will be charged for booking the Cancellation Risk Redemption.
15.2. Payment of the Travel Price will only be granted in the event of cancellation as a result of an uncertain event, as referred to in points a to g:
a. Death, serious illness or serious accident injuries of the Participant, family members in the 1st or 2nd degree or housemates of the Participant;
b. A medically necessary procedure that the Participant may undergo unexpectedly;
c. The Participant's inability to undergo a mandatory vaccination for the Event based on medical advice;
d. Unexpected call from the Participant for a re-examination that cannot be taken at a time other than during the Event;
e. The failure of the private means of transport to be used by the Participant with which the Participant would travel abroad to the Event due to an external calamity, within 30 days before the start of the Event;
f. Unexpected failure to obtain the required visa through no fault of the Participant;
g. Complications during Participant's pregnancy.
Article 17 - Complaints and imperfections
17.1. Complaints and imperfections must always first be reported by the Client and/or Participant to the Supervisor of the Event, so that they can be resolved on the spot.
17.2. If the complaint or imperfection is not properly resolved, the Client and/or Participant must have the Supervisor of the Event prepare a written report.
17.3. A complaint or imperfection must be submitted in writing via events@hockeycentre.nl within two weeks after the end of the Event; . In any case, this written complaint states:
a. Date of the complaint, name, telephone number(s) and email address;
b. Name, telephone number(s) and email address of complainant(s);
c. Name of Client and Participant;
d. Name, location and dates of the Event;
e. Type and description of the complaint;
f. A copy of the written report from the camp management.
17.4. A complaint will be answered in writing as soon as possible, but in any case within three weeks of receipt.
17.5. If a complaint is not handled within the period referred to in paragraph 4 of this article, Hockey Below The Sea will send an acknowledgment of receipt within this period and specify a new period within which a response can be expected.
17.6. Complaints and imperfections submitted by the Client and/or Participant after return without being recorded in writing by the Supervisor of the relevant Event will not be processed.
Article 18 - Applicable law
18.1. The Agreement and all agreements arising from it are exclusively governed by Dutch law.
18.2. All disputes that may arise between the parties as a result of the Agreement or agreements arising from it will be settled by the competent judge of the court in Amsterdam.
